This is a charge of the rape of a girl under the age of 18 years, and upon a trial thereof appellant was found guilty and given a penalty of a life term in the state prison, and he appeals.

The testimony shows that the girl, Shirley Mae Johns, was 13 years old at the time of the alleged occurrence. This girl's mother was married to appellant and died some three months after the girl's birth. The child was for awhile reared by the defendant...
