Plaintiff in error, to whom we hereinafter refer as defendant, has sued out a writ of error to have reviewed by this court a judgment and sentence of death pronounced against him on a verdict of first degree murder. It was charged in the information that on the 22nd day of March, 1949, the defendant "did unlawfully, feloniously, wilfully, deliberately and of his premediated malice aforethought, kill and murder one Remiga Marie Ramirez."
