WENNERSTRUM, Justice.

The plaintiff, a physician and surgeon, sought in an equity action to determine his rights under a written agreement wherein the defendant purportedly agreed to pay the plaintiff for professional services rendered to an uncle and the defendant. The district court held that under the agreement in issue defendant was obligated to pay the amount of the accounts claimed due. He has appealed.
