MILLER, Justice.

This suit was instituted by appellant, Harry G. Leckie, against appellee, Lynchburg Trust and Savings Bank, Executor of Herbert E. DeWitt to secure specific performance of an oral agreement for sale of real estate.

The contract sought to be enforced and under which appellant purchased from Herbert E. DeWitt two acres of land known as the "warehouse property" lying just outside the corporate limits of the city of Lynchburg had been entered...
