Defendant was charged with the offense of murdering one Jack Latham. A jury trial resulted in a verdict of guilty of murder in the first degree with recommendation of life imprisonment.

Prior to the 21st day of December, 1945, Latham owned and operated a tire shop at 2190 Main Street in San Diego. On the evening of December 20th, Mr. Flinn, a truck driver employed by Latham, left the premises at about 5:30 and at that time Latham was in the shop...
