In this action of trespass on the case, instituted in the Circuit Court of Cabell County, the jury returned a verdict for plaintiff, Anna Porter Burdick, and against the defendant, the City of Huntington, in the amount of five thousand dollars. Judgment was rendered on the verdict, and, on petition of defendant, this Court granted a writ of error.
