The plaintiff in error, Billy W.M. Walker, defendant below, was charged by information, tried by a jury and convicted of the crime of the murder of Dan Mingo. It was alleged in the information the defendant shot Dan Mingo three times inflicting such bodily wounds on him from which the said Dan Mingo died shortly thereafter.
