This original petition for compensation was brought under the provisions of the workmen's compensation act, general laws 1938, chapter 300. After a hearing in the superior court a decree was entered denying and dismissing the petition, and thereafter an appeal to this court was duly prosecuted by the petitioner.

The evidence showed that at the time of the trial the petitioner was fifty-seven years of age; that he began working for the respondent...
