The plaintiff herein is the executor of the estate of Rose Vertun, deceased, who was the mother of Fannie Loewenstein, otherwise known as Fannie Vertun. The defendant was the husband of Fannie Loewenstein.

It appears that on the 25th day of November, 1940, Fannie Vertun Loewenstein was committed to the Brooklyn State Hospital as an alleged incompetent and later transferred to the Kings Park State Hospital, where she is still an inmate...
