Appellant, William Rainey Britton (hereinafter referred to as Rainey or defendant), was convicted in the Circuit Court of Crawford County of murder in the second degree for the killing on May 1, 1948, of his brother, Woodrow Britton, and in accordance with the verdict of the jury was sentenced to a term of ten years' imprisonment in the penitentiary, and he appeals.
