This is an action by the United States to recover the balance claimed to be due on peanuts that were destroyed by fire. Part of the peanuts in question were sold and delivered by plaintiff to defendant, Greenwood Products Company, under a conditional sales contract arrangement and were destroyed while they were in possession of said defendant, under said contract arrangement, but before legal title had passed.
