(After stating the foregoing facts.) The bill of exceptions contains a statement that, in order to simplify the main questions involved in the motion for new trial, as amended, counsel of record for Lillie Mae Barnes advises the court that ground one of the amended motion will not be insisted upon. Accordingly, the first special ground of the motion for new trial does not present any question for decision by this court.
