THOMAS, Circuit Judge.

This is a suit upon a life insurance policy issued by the United States of America to Sol N. Bloom. The defense was fraud in the procurement of the policy. At the conclusion of the evidence counsel for the government moved for a directed verdict. The motion was sustained and a judgment was entered on the merits dismissing the case, from which judgment plaintiff appeals.
