Plaintiff in error, William Russell Simmons, (defendant,) was indicted in the circuit court of Franklin County on the charge of manslaughter by the negligent operation of an automobile upon the public streets in the city of West Frankfort, resulting in the death of Phyllis Joy Paternel. The defendant pleaded not guilty, was tried by a jury and found guilty, and sentenced to the penitentiary...
