Appellant Wescott and his codefendant Fehr were charged with the crime of murder, to which they both pleaded not guilty. At the conclusion of the prosecution's case Wescott moved for an advisory verdict and for a dismissal as to himself, both of which motions were denied. Following the jury's return of verdicts of guilty against both defendants, Wescott moved for a new trial and now appeals from the denial thereof...
