GAILOR, Justice.

This is a controversy over the distribution of a sum of money paid in settlement of a claim for wrongful death under the Federal Employers' Liability Act, Title 45 U.S.C.A. § 51 et seq.

The deceased employee, Boyd L. Smith, worked for the Southern Railroad in employment protected by the Federal Act. On May 9, 1949, he fell in a hole at the Coster Shops of the Railroad, and received the injuries which caused his death on May 16, 1949....
