MARBURY, C.J., delivered the opinion of the Court.

The accident, from which this case arose, took place on the morning of September 24, 1948, about 6:15 a.m., at the intersection of North and Pennsylvania Avenues in the City of Baltimore. The deceased, Alexander Stehley, was a 59 year old employee of the Baltimore & Ohio Railroad. He lived in Forest Park and worked at the Mt. Clare Shops. To reach his place of work it was his custom to leave home at 5:50 a.m....
