Defendants, with one Karl Johnson, were charged with the crime of conspiracy to commit grand theft on May 7, 1949, and in a second count of the information with the crime of theft of $357, the personal property of Winston W. Gay. A jury trial resulted in the acquittal of Johnson as to both counts, the conviction of the other defendants of conspiracy as charged in the first count of the information and in an acquittal as to the charge of grand theft.
