This action was brought by Della L. Metheny against defendant, Combined Mutual Casualty Company, a corporation, to recover on an insurance policy issued by said company to her husband, in which she was beneficiary. At the conclusion of plaintiff's evidence the trial court sustained the demurrer of defendant to the evidence, and thereafter upon motion of plaintiff granted a new trial.
