Appellant, Lyman Clark, brought this action to recover damages for the death of his wife alleged to be due to the negligence of James F. McClaskey, an engineer for the State Division of Highways, in the operation of a state automobile. Contributory negligence on the part of decedent was alleged by defendants. A jury returned a verdict in favor of defendants and from the judgment which followed this appeal has been taken.
