Alex N. Kazos, plaintiff sought in an action in equity to compel the removal of a loading dock which Ginsbergs, Inc., had constructed in a private alley to the rear of the property owned by plaintiff. The trial court refused to issue a mandatory injunction directing its removal. The plaintiff has appealed.
