This action was brought by plaintiff Blankenship, a sawmill operator, against defendant Derby, a general insurance agent, on account of the latter's failure to secure for Blankenship a policy of workmen's compensation insurance on his sawmill employees. One of plaintiff's sawmill employees was killed in the course of his employment and plaintiff personally is paying workmen's compensation benefits to the widow and children, under a Workmen's Compensation...
