SMITH, Justice.

Plaintiff is administratrix of the estate of her husband Lorin Rickabaugh. On December 11, 1946, her decedent, while driving a truck belonging to Burton Zerley, over a crossing of defendant Wabash Railroad Company near Dunreath, was struck and killed by a train of said company, operated by defendant Davis as engineer.

Plaintiff sought damage for the death of decedent in the sum of $15,000 and an additional $1400 for property damage to the truck...
