On June 30, 1949, Rose City Foods Inc. brought an equitable suit against Bank of Thomas County. Its petition, as twice amended, prayed for process; for certain injunctive relief; for the court's construction of two like bills of sale; and for general relief. The defendant answered the amended petition and later amended its answer, and by way of cross-action alleged that the plaintiff had wrongfully converted the property involved in this litigation...
