SIMMONS, Chief Justice.

This is an action for damages for the death of plaintiff's decedent. The cause was tried to a jury, resulting in a verdict for the plaintiff. The defendant filed a motion for judgment and, in the alternative, for a new trial. The motion for judgment was sustained and judgment rendered in favor of defendant. The trial court reserved a ruling on the motion for a new trial. On appeal here, by our opinion in 152 Neb. 39
