This is a habeas corpus proceeding before the proper Chancellor for enlargement upon bail, — petitioner being under indictment and arrest for murder. The Chancellor's decree contained the following provisions: "It is, therefore, ordered, adjudged and decreed that the demurrer of the defendant, W.L. Crumpton, be and it is hereby sustained and the petition dismissed and the prisoner, Bryan Russell, ordered returned to jail by the defendant...
