This action was one for possession of an apartment for the landlord's "immediate and personal use and occupancy as a dwelling," as authorized by the local Rent Act.1 The trial judge refused to take from the jury the question as to whether the landlord had accepted rent payments for periods after the expiration of the notice to quit.
