This appeal brings to us for review an order dismissing a bill for a declaratory decree containing the simple prayer that Chapter 26053, Laws of Florida, Special Acts of 1949, be pronounced unconstitutional.

There were no parties to the suit save the appellant, a municipality, and the appellee, the owner of property within the original, but without the new, city boundaries.
