Plaintiff brought this action to recover damages for the death of her husband, George Burkstrand, resulting from his being struck by an automobile driven by defendant Rasmussen, which, plaintiff claims, was caused by the negligence of the defendant. The case was tried to a jury and resulted in a verdict in favor of the defendant for a dismissal of the action.

The plaintiff moved for a new trial on the following grounds:
