The writ of habeas corpus was issued in this case upon a verified petition which recited that Hayes was in custody by reason of a warrant issued by the governor of this state in an extradition proceeding to answer a charge of abandonment and desertion of his minor children in the State of Oklahoma. The petition alleged that neither the demand nor warrant from the Governor of Oklahoma alleges that Hayes was present in Oklahoma at the time of the commission...
