THAXTER, Justice.

This action of assumpsit was tried before a jury in the Superior Court in the County of Kennebec. The jury found for the plaintiff for $4,624.66 which was within about $250 of the balance claimed to be due on an account for work and labor performed, materials furnished, and equipment used by the plaintiff for the defendant at its request. The case is before us on the defendant's general motion for a new trial.
