Defendant, The Croswell Company, Inc., executed a chattel mortgage and note in the sum of $10,000.00 dated June 22, 1948 and filed for record June 23, 1948. A foreclosure sale in a suit by plaintiff was held June 20, 1949. The mortgaged property brought less than the amount due on the mortgage note. Prior to the above mentioned sale, Miss Lucy L.
