This is an appeal from a judgment following an order sustaining the defendant's demurrer to the complaint without leave to amend. The action is based on the alleged negligence of Emerald J. Steen when her automobile, in which the plaintiff was riding as a passenger, collided with a truck. The collision occurred on April 24, 1947. Thereafter Emerald J. Steen died.
