SCHWELLENBACH, J.

September 20, 1949, Honorable James W. Hodson signed and entered a decree of divorce in a matter heard in King county entitled, "Donald Hale, Plaintiff, v. Mary Jane Hale, Defendant." The decree granted a divorce to both parties. It also provided:

"Defendant MARY JANE HALE is granted the care, control and custody of DONNA LEE HALE, the minor child of the parties, with the right reserved in the plaintiff...
