This action in habeas corpus originated in this court.

It is the claim of the petitioner, a prisoner in the Ohio Penitentiary, that he is illegally and unlawfully restrained of his liberty. He is serving a sentence of from one to twenty years in the penitentiary on a commitment from the Court of Common Pleas of Hamilton County, after conviction of the crime of sodomy.
