Plaintiff in error, John Mathews, with Gilbert Peterson and James Davis, was indicted in the circuit court of Woodford County, at the April term, 1949, for the crime of burglary and larceny. The indictment consisted of two counts, the first charging breaking and entering and the second entering without force. Pleas of not guilty were entered, but on the trial Peterson and Davis...
