Action by an employee against his employer, who did not have compensation insurance, for damages for personal injuries sustained in the course of his employment. In a trial by jury, wherein Judge Frank M. Smith presided, the plaintiff obtained judgment for $8,000. Defendant's motion for a new trial was granted by Judge Clarence M. Hanson, and the plaintiff appeals from the order granting that motion. Defendant appeals from the judgment.
