In this action the plaintiff alleged that on April 28, 1947, he left with the Fontana Branch of the defendant bank the sum of $2,500 in cash; that the defendant received this sum and agreed to repay the same to him on his order; that the defendant misappropriated the whole sum on April 29, 1947; and that his demands for payment of said sum have been refused.
