The action is brought pursuant to the provisions of O.C.L.A., § 87-328 as amended by Oregon Laws 1945, ch. 124, which provides as follows:

"In any county having less than 45,000 inhabitants county surveyors shall be allowed $15 per day each for their services while actually and necessarily engaged in performing the duties of their offices and they shall be allowed for traveling...
