This is a second appeal of appellee's suit for collection of delinquent Levee District taxes against appellant's 34.4 acres of land. See Tex.Civ.App., Waco, 199 S.W.2d 230 and 146 Tex. 95, 202 S.W.2d 918, for relevant facts and law of the case as there determined. Upon a trial, the court withdrew the cause from the jury after both parties had moved for an instructed verdict, then rendering judgment against defendant in amount of $4,762.20, taxes claimed...
