The tenant herein appears specially and moves to vacate the service of the precept and to dismiss the same on the ground that this court has no jurisdiction of the person of the tenant, pursuant to rule 107 of the Rules of Civil Practice and as provided for in the Constitution of the United States and former section 256 of the Judicial Code of the United States (now U. S. Code, tit. 28, § 1251).
