R.E. Grimm, plaintiff, instituted this action in assumpsit against Edward S. Schrock and Minerva Schrock, defendants, claiming damages for the alleged breach of warranty for quiet enjoyment in a timber deed in which defendants are the alleged covenantors. Preliminary objections were filed by defendants and are now before the court for disposition.
