In an action for damages for breach of promise to marry, wherein the jury gave plaintiff a verdict for $5,000, defendant made a motion for judgment non obstante or a new trial, which was granted unless plaintiff filed a written remittitur consenting to a reduction of $1,000 in the amount of the verdict. Plaintiff consented to the remittitur, and in consequence thereof defendant's motion for a new trial stood denied, and from this order...
