This is an original proceeding under M.S.A. 202.082 upon the application of petitioner for an order requiring respondent, as secretary of state, to place petitioner's name upon the ballot as a candidate for the office of associate justice of the supreme court at the forthcoming November general election.

The terms of three of the associate justices of the supreme court will expire on the first Monday in January...
