GRIFFIN, J.

It is charged in the information that defendant assaulted one Wilton Roy Young with a deadly weapon. He pleaded not guilty. A trial by jury resulted in a verdict of guilty.

On appeal it is contended that the verdict is contrary to the law and evidence and that the court erroneously instructed the jury. Young and a girl whose name he did not know, were sitting at a bar. Defendant, a sailor in the United States Navy, entered the bar and seated himself...
