This is an action in assumpsit to recover the proceeds of a life insurance policy issued by the defendant, hereinafter called the company, upon the life of plaintiff's husband James Russell, wherein she is named the beneficiary. At the trial to a jury in the superior court the plaintiff was nonsuited.
