FELLOWS, Justice.

This action of assumpsit for money had and received, with specifications under omnibus counts, was tried before a jury in the Superior Court for Sagadahoc County. The jury returned a verdict for the plaintiff for $520.00. The case comes to the Law Court on the defendant's general motion for a new trial. The grounds stated in the motion are that the verdict is against the law and the evidence. There is no claim for excessive damages.
