The respondent, owner of a grocery store in Moberly, Missouri, brought this action to recover $1000, represented by the check of the appellant in that amount alleged to have been given by appellant as earnest money and as part payment on a contract to purchase the store and merchandise therein, on which check appellant stopped payment and, it is claimed, repudiated the purchase contract.
