POWELL, J.

The plaintiff in error, Howard Farley, hereinafter referred to as defendant, was tried and convicted in the district court of Woods county, Oklahoma, for the crime of grand larceny, and the jury being unable to agree upon the amount of his punishment, the same was fixed and assessed by the court, and defendant was sentenced to imprisonment in the penitentiary for a term of one year. Appeal has been perfected to this court.
