This is a suit by the insurance carrier of the Ingalls Iron Works Company against the Louisville & Nashville Railroad Company under authority of Title 26, section 312, Code 1940. Wilmer Warren, an employee of the Ingalls Iron Works Company was killed as the result of an accident on June 26, 1942, in the course of and arising out of his employment.
